1. General provisions
The MONÉLY online shop at moneli.store is operated by [to be completed by the shop owner], tax identification number (NIP) [to be completed by the shop owner], registered at [to be completed by the shop owner].
Contact: [to be completed by the shop owner], [to be completed by the shop owner]. The address for correspondence and returns is the registered address unless the shop states another address when confirming an order.
These terms set out how distance contracts are concluded, the rights and obligations of both parties, and the complaints procedure. Nothing here limits the consumer rights granted by mandatory provisions of law.
2. Customer account
Creating an account is voluntary and free. You are responsible for the accuracy of the details you provide and for keeping your password confidential.
One email address and one phone number may be linked to a single account only. If unauthorised access is suspected, the shop may temporarily restrict access while it verifies the situation.
You may delete your account at any time by contacting us. Deletion does not affect orders already placed or the seller's record-keeping obligations.
3. MONÉLY Circle
On registration you receive 300 welcome points. One point equals one złoty of discount.
Points may cover up to 20% of the value of the goods, after any discount code and excluding delivery costs. Points cannot be exchanged for cash.
Points earned on an order are reversed if you withdraw from the contract or the order is cancelled; points you spent on that order are returned to your account.
4. Placing an order and concluding the contract
Product information in the shop is an invitation to conclude a contract, not an offer within the meaning of the Civil Code.
You choose the product, variant, quantity, delivery and payment method, and provide the details needed to fulfil the order. The order is placed by pressing the button marked as an order with an obligation to pay.
The contract is concluded when the seller confirms acceptance of the order by email, together with the order number.
5. Prices and payment
Prices are given in Polish złoty and include VAT. They do not include delivery costs, which are shown before the order is placed.
Available payment methods: BLIK, instant bank transfer, payment card and cash on delivery. Electronic payments are handled by an external payment provider; the shop does not store full card details.
A sales document is issued for every order in accordance with applicable law.
6. Delivery
Orders are delivered through InPost parcel lockers and the DPD courier within Poland, and by shipment to selected European Union countries.
Delivery within Poland is free for orders from PLN 300.00.
Delivery time runs from the day payment is credited, or from the day the order is confirmed where payment is on delivery. The seller notifies you of dispatch together with the tracking number.
7. Right of withdrawal
A consumer — and a natural person concluding a contract directly connected with their business where the contract is not of a professional character for them — may withdraw from the contract without giving a reason within 14 days.
The period runs from the day the consumer, or a third party other than the carrier indicated by them, takes possession of the goods. Sending the statement before the deadline is enough to meet it.
The statement may be made in any form, in particular by writing to [to be completed by the shop owner]. Returned goods should be sent back without undue delay and no later than 14 days from the statement.
The seller refunds the payments received, including the cost of the cheapest delivery method offered, without undue delay and no later than 14 days from receiving the statement. The seller may withhold the refund until the goods are received or proof of their return is provided.
The direct cost of returning the goods is borne by the consumer. The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
The right of withdrawal does not apply in the cases listed in Article 38 of the Consumer Rights Act, in particular to goods delivered in a sealed package which cannot be returned after opening for health or hygiene reasons, where the package was opened after delivery.
8. Complaints and goods not in conformity with the contract
The seller is liable for any lack of conformity of the goods with the contract on the terms set out in the Consumer Rights Act.
Where goods are not in conformity with the contract, the consumer may request their repair or replacement. If repair or replacement is impossible or would involve excessive cost, the consumer may make a statement reducing the price or withdrawing from the contract on the terms provided by law.
Complaints should be sent to [to be completed by the shop owner] with the order number and a description of the defect. The seller responds within 14 days.
9. Out-of-court dispute resolution
A consumer may use out-of-court complaint and redress procedures, in particular permanent consumer arbitration courts, mediation conducted by the regional inspectorates of the Trade Inspection, and the assistance of the district or municipal consumer ombudsman.

Use of out-of-court procedures is voluntary.
10. Personal data
The controller of customers' personal data is the seller. Detailed information on processing, the legal bases and the rights of data subjects is set out in the Privacy Policy.
11. Final provisions
Colours on screen may differ slightly from the actual product depending on your device. Measurements given on a product page are indicative and taken on the finished garment.
The seller may amend these terms for important reasons. Orders placed before an amendment are governed by the terms in force on the day the order was placed.
Matters not covered here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
